Terms and Conditions

These Terms and Conditions ("Terms") govern your use of Dink Play — the website, mobile interface and related services (together, the "Platform") operated by RRM DEVCORE SOFTWARE DEVELOPMENT SERVICES ("we", "us", "our"), with its address at Unit 15 Erlinda Apartment, Kapalaran Street, Barangka Drive, City of Mandaluyong, NCR, Philippines.

By creating an account, making a booking or otherwise using the Platform you agree to these Terms. If you do not agree, please do not use the Platform. These Terms are an electronic contract; under the Electronic Commerce Act (Republic Act No. 8792) your electronic acceptance has the same legal effect as a signed paper contract.

1. What Dink Play is

Dink Play is an online marketplace that helps:

  • Players discover pickleball courts, book court time, find coaches and book coaching sessions;
  • Court Owners list courts and receive court bookings; and
  • Coaches list coaching services and receive coaching bookings.

Dink Play provides the technology that connects these parties and processes payments through licensed third-party payment providers. Court Owners and Coaches are independent businesses or professionals, not our employees, agents or partners in a joint venture. The court or coaching service is provided by the Court Owner or Coach, who is responsible for it. We are not a party to the booking contract for the court or the coaching session except where we say so (for example, where we collect payment on a Court Owner's or Coach's behalf).

Separate terms apply to Court Owners (Court Owner Terms) and Coaches (Coach Terms). Our Privacy Policy, Cancellation and Refund Policy and Cookie Policy form part of these Terms.

2. Eligibility and accounts

  1. You must be at least eighteen (18) years old, the age of majority in the Philippines, and have the legal capacity to enter into a contract. A parent or legal guardian may book on behalf of a minor and is responsible for that minor's participation, conduct and safety.
  2. You may book as a guest or with an account. You must give accurate, current contact details and keep your login credentials confidential. You are responsible for activity under your account; tell us promptly if you suspect unauthorised use.
  3. You may not create an account for anyone else without their authority, or hold duplicate accounts to avoid a suspension or to abuse promotions.

3. Bookings and payments

  1. Prices. Court and coaching prices are set by the Court Owner or Coach and shown in Philippine pesos (₱) before you pay. Where Dink Play charges a service fee or convenience fee, it is shown as a separate line before you confirm and pay, and is included in the total you are charged. Whether a fee applies depends on how the booking is paid and on our current fee settings; it can differ between bookings, and the fee shown at checkout is the fee for that booking.
  2. Membership. If you hold a Dink Play membership, the platform commission we charge the Court Owner or Coach may be lower. Membership never changes the price the Court Owner or Coach has listed.
  3. Payment methods. Depending on the venue, you may pay online (for example by card, GCash, Maya or QR Ph) through our payment service provider, or pay at the venue. Online payment is processed by a licensed third-party provider; we do not store your full card number.
  4. Confirmation. A booking is confirmed when you receive a confirmation (on screen and by email). A held slot that is not paid within the stated hold time is released.
  5. Taxes. Prices are inclusive of any taxes the Court Owner or Coach is required to charge unless stated otherwise.
  6. Cancellation and refunds are governed by the Cancellation and Refund Policy shown to you at checkout. The policy displayed when you book is the policy that applies to that booking.

4. Using courts and coaching safely

Pickleball is a physical activity with an inherent risk of injury. By booking you confirm that you are physically able to take part, that you will follow the venue's rules and the coach's reasonable instructions, and that you take part at your own risk, subject to the Court Owner's and Coach's duty to take reasonable care and to the rights you cannot waive under Philippine law. Warm up, use appropriate footwear and eyewear, and stop if you feel unwell.

5. Your conduct

You agree not to: provide false information; use the Platform unlawfully or to harass, abuse, discriminate against or threaten anyone (including conduct prohibited by the Safe Spaces Act, Republic Act No. 11313); interfere with the Platform's security or operation; scrape, reverse-engineer or overload it; circumvent fees by taking a booking made through the Platform off-platform to avoid commission where our Court Owner or Coach Terms prohibit it; post unlawful, defamatory or misleading reviews; or damage a venue's property. You are responsible for damage you cause at a venue.

6. Reviews and content

Players who completed a coaching session may rate and review the Coach. Reviews must be honest, based on your own experience, and free of unlawful or abusive content. You grant us a non-exclusive, royalty-free licence to display your review and the content you upload (for example a profile photo) on the Platform for as long as it is displayed. We may remove content that breaches these Terms.

7. Our role, disclaimers and limits of liability

  1. We provide the Platform "as is" and "as available" and do not guarantee uninterrupted or error-free service.
  2. We do not own, operate or control the courts or coaches listed, and we do not guarantee the quality, safety, legality or availability of any court or coaching service. Coaches are verified for identity as described in the Coach Terms; verification is not a guarantee of skill, qualification or conduct.
  3. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss caused by a Court Owner, a Coach, another user or a third-party provider. Nothing in these Terms excludes liability that cannot be excluded under Philippine law, including liability for fraud or wilful misconduct (Civil Code, Article 1170 and related provisions) or your rights under the Consumer Act of the Philippines (Republic Act No. 7394).
  4. Subject to the above, our total liability to you for a booking is limited to the amount you paid through the Platform for that booking.
  5. Neither party is liable for failure caused by events beyond reasonable control (a fortuitous event under Civil Code, Article 1174), including typhoons, floods, earthquakes, government orders and power or network failures. Refunds in such cases follow the Cancellation and Refund Policy.

8. Suspension and termination

We may suspend or close an account, cancel bookings and withhold payouts where we reasonably believe there is fraud, abuse, unlawful activity, a breach of these Terms or a risk to others, or where required by law. We will tell you why where we can. You may close your account at any time; bookings you have already made remain subject to these Terms.

9. Privacy and cookies

We process personal data under the Data Privacy Act of 2012 (Republic Act No. 10173). See our Privacy Policy and Cookie Policy.

10. Complaints and disputes

Contact us first at support@dinkphplay.com; we aim to acknowledge complaints within two (2) business days and resolve them within fifteen (15) business days. If you are a consumer you may also contact the Department of Trade and Industry (DTI). You and we agree to try to resolve any dispute in good faith, including through mediation, before going to court (see the Alternative Dispute Resolution Act of 2004, Republic Act No. 9285). Nothing here limits your right to bring a complaint before any competent Philippine authority or court.

11. Changes to these Terms

We may update these Terms. We will post the new version with its effective date and, for material changes, notify you by email or on the Platform. Using the Platform after the effective date means you accept the update; bookings you made before then keep the cancellation policy you saw at checkout.

12. General

These Terms are governed by the laws of the Republic of the Philippines. Subject to any mandatory consumer protection rule, the proper courts of Mandaluyong City, Metro Manila have jurisdiction. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign your rights under these Terms without our consent.
